A Westborough clerk magistrate has found no probable cause behind a police brutality complaint filed against a Marlborough cop, Police Chief Mark Leonard said yesterday.
Samuel Velazquez, 27, filed an assault and battery complaint in March against Sgt. Timothy Harpin. Velazquez, a Framingham resident, said Harpin pushed him three times while he was leaving Marlborough police headquarters, after being arrested on motor vehicle charges, earlier that month.
Velazquez has filed complaints against Marlborough and Framingham police in the past, police officials said, but this one went further than others, winding up with the clerk magistrate.
A police department internal investigation also exonerated Harpin, Leonard said. "We believe the officer was justified in his actions," Leonard said. "The decision by the magistrate confirmed that."
Leonard said the police department learned of the magistrate's decision last month.
Velazquez could not be reached for comment, yesterday.
